Leftwich & Ludaway is uniquely qualified to represent government agencies and entities in asset disposition and related matters. Since its inception, L&L has represented the Federal Savings and Loan Insurance Corporation (FSLIC), the Resolution Trust Corporation (RTC), the Federal Deposit Insurance Corporation (FDIC), the U.S. Department of Housing and Urban Development (HUD), and the U.S. Small Business Administration (SBA) in connection with significant asset disposition programs and related litigation and dispute resolution. These representations have covered all phases of the disposition programs including program and policy development, program implementation, legislative analysis and drafting, individual sales initiatives, post-sale assistance, litigation, and dispute resolution. The firmís government asset disposition practice breaks down into three main categories: bulk and individual sales of assets; structured sales and securities; and litigation and dispute resolution.

L&L has helped government clients navigate through the difficult policy issues related to asset disposition. We have represented clients in transactions involving tens of thousands of performing, subperforming and nonperforming loans and participation interests. The firm has worked on sales in which the aggregate unpaid principal balance of the loans sold exceeded $11 billion.

The firm represented HUD in the development and implementation of the complex accelerated claims disposition program designed to reduce HUDís FHA insurance costs. It also has worked on a range of structured sales, transactions, and securitizations for the RTC and other governmental entities.

L&L has extensive experience litigating in these areas, including successful representation of RTC in suits filed by unsuccessful bidders and assistance provided to HUD in litigation arising as a result of loan sales.
